Question: about selling cars and the title.

Here's an Evo for looking, because why not.

Here is my issue, when I bought my car (in '10) my name was suppose to be on the title, with my father as the co-owner/signer. Years later, I discovered that my father is the main name on the title. I should also state my father lives in FL and I reside in MI. I might need to trade in my car for another one, but is it possible for me to do that if my name isn't on the title and my father isn't around?

Edit: I bought the car in FL.

Generally speaking, no.

In specific cases, i.e. your father is not legally able to sign documents, and a proper Power of Attorney is executed, you would be able to sign on your own.

Check with the MI Title office to see if they accept a notarized PoA for assigning title.

Either way, you will likely have to take a trip to FL to either get him to sign the title, or both of you to get a PoA notarized.

You should call the SOS and find out for sure. My guess is that you'll have to either mail it to him, have him sign it, and mail it back. If this isn't an option, then you may have to have someone at the SOS to help you.

The way to do this would be to have him sign the Florida title to you, you apply for a Michigan title in your sole name, then you can sell the car.

You did establish Michigan residency right?

Possibly, but I don't know for sure as I don't know MI's laws.

What I would do is have the title signed over to your name before you trade in the car.
